The following 90 Day Repair Warranty against manufacturer defect(s) applies to eligible devices purchased from SFone Wireless ("Warranty"). For purposes of this Warranty, “Wireless Provider” is defined as SFone Wireless which is the wireless service provider from which you purchased your device. The 90-day term of this Warranty will commence upon purchase of your device. In the event (i) your device experiences manufacturer defects within ninety (90) days from the date of purchase and (ii) you report a valid claim within such ninety (90) days ("Covered Period"), the Wireless Provider will repair your device. Prior to approving your claim, the Wireless Provider will evaluate your device to confirm eligibility, including, without limitation, confirming the ESN and date. This Warranty is not an insurance policy, nor does it cover lost or stolen phones, normal wear and tear, damages resulting from fire and/or water, accident or abuse, or cracked screens. Upon Wireless Provider request for further investigation, a pre-programmed loaner device and a return shipping label will be sent. This Warranty program may be modified or cancelled by the Wireless Provider at any time, in its sole discretion. Because the Warranty is provided at no additional charge, there will be no refunds in the event of a modification or cancellation. Under the circumstances that the device is not covered under the Warranty, repair fee(s) will be charged to the Account Holder SFone Wireless Account. Subsequent to receiving the repaired device, the pre-programmed loaner device must be return to the Wireless Provider within ten (10 days). REPAIR AS PROVIDED UNDER THIS EXPRESS WARRANTY IS THE EXCLUSIVE REMEDY OF THE CONSUMER AND IS PROVIDED IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL THE WIRELESS PROVIDER BE LIABLE, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE DEVICE, OR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, SOFTWARE OR APPLICATIONS, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE DEVICE, ACCESSORIES OR SOFTWARE TO THE FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.
Some states and jurisdictions do not allow the limitation or exclusion of incidental or consequential damages, or limitation on the length of an implied warranty, so the above limitations or exclusions may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights that vary from state to state or one jurisdiction to another.
CLAIMS: Please call our customer support team at 1-800-444-4080 between the hours of 8:00 a.m. CST and 5:00 p.m. CST Monday – Friday & 9:00 a.m. CST – 6:00 p.m. CST Saturday – Sunday to submit a warranty claim. Upon acceptance of your claim, we will provide instructions on how to ship your device for repair(s). Wireless Provider will provide a pre-programmed loaner device and a return shipping label. Prior to sending the Wireless Provider the device for repair(s), please back-up data, pictures, video, media, software, applications, or files and remove any removable hard drive or storage device from the Device, as the Wireless Provider is not responsible for any loss, corruption, modification, or failure of data, pictures, video, media, software, applications, or other files on your device. Upon receipt of the device with all applicable documentation and/or information, inspection and validation of your claim, if your claim is approved, we will send you the repaired device in accordance with this Warranty. In the event that the device is deemed not eligible for the Warranty, the device will be repaired and the fee(s) will be charged to the Account Holder SFone Wireless Account. Upon the receipt of the repaired device, there is a ten (10) day policy in which the pre-programmed loaner device must be return to us at 9920 Brooklet Drive, Houston, Texas 77099. Claims must be made within 90 days of your date of purchase to be eligible for Warranty, regardless of period of time when the defect(s) occurs.
